河北省大氣辦發文嚴禁“一刀切”

近日,河北省大氣辦印發(fa)《河北省嚴(yan)格禁(jin)止生態(tai)環境(jing)(jing)保護領域(yu)“一(yi)刀切(qie)”的指導意(yi)見》,要(yao)(yao)求(qiu)各地、各部門在推(tui)進生態(tai)環境(jing)(jing)保護打好污染防(fang)治攻(gong)堅戰工作中(zhong),要(yao)(yao)以(yi)統籌污染治理與(yu)經濟發(fa)展、社會(hui)民生相協(xie)調為重點(dian),按照(zhao)污染排放績效和(he)環境(jing)(jing)管(guan)(guan)理實(shi)際需要(yao)(yao),科學制(zhi)定實(shi)施(shi)(shi)差異化管(guan)(guan)控(kong)措(cuo)施(shi)(shi)和(he)監管(guan)(guan)措(cuo)施(shi)(shi),堅決反對“一(yi)刀切(qie)”。


一、 總體要求

堅(jian)(jian)持(chi)以(yi)習近平生(sheng)態文明思(si)想(xiang)(xiang)為(wei)統(tong)領,牢固樹立以(yi)人民為(wei)中(zhong)心的(de)發展思(si)想(xiang)(xiang),認(ren)真貫徹落實高質量(liang)發展要求,堅(jian)(jian)決反(fan)對形(xing)式主義、官僚主義,以(yi)改善(shan)生(sheng)態環境(jing)(jing)質量(liang)為(wei)核心,以(yi)統(tong)籌污染(ran)(ran)治(zhi)理(li)與經濟(ji)發展、社會民生(sheng)相協調為(wei)重點(dian)(dian),針對污染(ran)(ran)防治(zhi)的(de)重點(dian)(dian)領域、重點(dian)(dian)區域、重點(dian)(dian)時段和(he)重點(dian)(dian)任務,按照污染(ran)(ran)排(pai)放績效(xiao)和(he)環境(jing)(jing)管(guan)理(li)實際(ji)需要,科學(xue)制(zhi)定實施差異(yi)化管(guan)控措施和(he)監管(guan)措施,堅(jian)(jian)決反(fan)對“一刀切”,有效(xiao)減(jian)少污染(ran)(ran)物排(pai)放,推動企業(ye)綠色發展和(he)產(chan)業(ye)轉型(xing)升級,促進生(sheng)產(chan)、生(sheng)活與生(sheng)態同步改善(shan)。


二、把握原則

1.堅持目標需求,質量導(dao)向(xiang)。科學(xue)制訂(ding)區域、行(xing)業(ye)環境(jing)管理目標和產(chan)業(ye)發(fa)展規劃,積極推(tui)進供(gong)給側結構性改革,著力突出(chu)污(wu)染(ran)減(jian)排,對標高(gao)質量發(fa)展要(yao)求,系統開展排放(fang)績效評價,鼓勵采(cai)用先(xian)進生(sheng)產(chan)技術和污(wu)染(ran)治理設施,提高(gao)污(wu)染(ran)治理能力,提升環境(jing)管理水平,實現清潔生(sheng)產(chan),推(tui)動重點(dian)行(xing)業(ye)企業(ye)向(xiang)超低排放(fang)、工藝技術先(xian)進、產(chan)品優質高(gao)端方向(xiang)轉型(xing)發(fa)展。

2.堅持分類(lei)指導,精準施(shi)策。科學(xue)研判不同(tong)領域、不同(tong)行(xing)業的(de)(de)污染(ran)排(pai)放(fang)(fang)特點和區(qu)域環(huan)境管(guan)(guan)理(li)(li)需求,針對性地細(xi)化防止“一刀切”的(de)(de)具(ju)體措施(shi)和工作方法。對工業企(qi)業特別(bie)是高能耗、高污染(ran)的(de)(de)行(xing)業,按照不同(tong)行(xing)業細(xi)化評判標準,嚴格排(pai)放(fang)(fang)監督管(guan)(guan)理(li)(li),科學(xue)評定企(qi)業的(de)(de)污染(ran)排(pai)放(fang)(fang)績效水平,實行(xing)分類(lei)管(guan)(guan)理(li)(li)、差異(yi)化錯峰生產,堅持多排(pai)多減、少排(pai)少減、不排(pai)不減的(de)(de)原(yuan)則,形成(cheng)正(zheng)向激(ji)勵(li)機制,鼓(gu)勵(li)企(qi)業實施(shi)超低排(pai)放(fang)(fang)改造。

3.堅(jian)(jian)(jian)(jian)持(chi)有(you)(you)保(bao)有(you)(you)壓,獎優罰劣。要堅(jian)(jian)(jian)(jian)持(chi)民生優先,對涉及民生領域(yu)的(de)管控措施(shi),制定壓非(fei)保(bao)民工(gong)(gong)作方(fang)案,優先確保(bao)民生需求、扶貧攻堅(jian)(jian)(jian)(jian)、重點項目等工(gong)(gong)程實施(shi);要堅(jian)(jian)(jian)(jian)持(chi)有(you)(you)取有(you)(you)舍,對戰略性新興產業(ye)、現代服(fu)務業(ye)、環(huan)保(bao)“領跑者”企(qi)業(ye)和環(huan)境友好的(de)成長型中小微企(qi)業(ye),加大扶持(chi)力度,引導(dao)規(gui)范發展(zhan),保(bao)障(zhang)正常生產;要堅(jian)(jian)(jian)(jian)持(chi)淘汰落后,對不(bu)符合產業(ye)政策、手(shou)續不(bu)全、治理無(wu)望、不(bu)能穩定達標排(pai)(pai)放(fang)的(de)企(qi)業(ye),堅(jian)(jian)(jian)(jian)決(jue)依法關(guan)停取締,對資源(yuan)環(huan)境效(xiao)率低、排(pai)(pai)放(fang)總量大、污染嚴重的(de)高(gao)能耗、高(gao)污染行(xing)業(ye)企(qi)業(ye),堅(jian)(jian)(jian)(jian)決(jue)予以(yi)錯峰生產。

4.堅持從嚴從實(shi),依法監(jian)(jian)管(guan)(guan)。嚴格禁止生態環(huan)境(jing)保(bao)護領域“一(yi)(yi)刀切(qie)”,絕(jue)不(bu)意味著放松監(jian)(jian)管(guan)(guan),更(geng)不(bu)能在(zai)監(jian)(jian)管(guan)(guan)上(shang)失(shi)之于寬、松、軟,而是要(yao)求監(jian)(jian)管(guan)(guan)措(cuo)施(shi)更(geng)加(jia)精(jing)準、嚴謹、細致,監(jian)(jian)管(guan)(guan)標(biao)準更(geng)嚴、更(geng)高,監(jian)(jian)管(guan)(guan)力(li)度更(geng)大、更(geng)實(shi),著力(li)解(jie)決(jue)(jue)企業在(zai)污染防(fang)治(zhi)上(shang)“投(tou)入多投(tou)入少(shao)一(yi)(yi)個樣(yang),排放多排放少(shao)一(yi)(yi)個樣(yang)、排放或不(bu)排放一(yi)(yi)個樣(yang)”的問題,倒(dao)逼企業加(jia)大環(huan)保(bao)投(tou)入,實(shi)現超(chao)低排放,加(jia)速轉(zhuan)型升級,倒(dao)逼政府投(tou)入足夠(gou)人力(li)、物力(li)、精(jing)力(li),科學(xue)決(jue)(jue)策(ce),精(jing)細管(guan)(guan)理,建立清單,依法監(jian)(jian)管(guan)(guan),打贏污染防(fang)治(zhi)攻堅戰。


三、重點領域和行業

(一)嚴禁(jin)民(min)生(sheng)(sheng)領域環(huan)(huan)境(jing)管(guan)理(li)(li)(li)“一刀切”。對(dui)與民(min)生(sheng)(sheng)息(xi)息(xi)相關的(de)事項(xiang),堅持民(min)生(sheng)(sheng)優(you)先、服(fu)(fu)(fu)務(wu)(wu)至上、力(li)求保障(zhang),不斷提(ti)(ti)升(sheng)環(huan)(huan)境(jing)管(guan)理(li)(li)(li)水平。對(dui)涉及重大民(min)生(sheng)(sheng)、扶貧易地搬(ban)遷的(de)建設(she)項(xiang)目和國家、省(sheng)重點(dian)項(xiang)目,要開通項(xiang)目審批“綠色通道”,克服(fu)(fu)(fu)通常觀念,優(you)化(hua)服(fu)(fu)(fu)務(wu)(wu)流(liu)程,縮(suo)短審批時間,減少體外環(huan)(huan)節(jie)(jie),提(ti)(ti)高服(fu)(fu)(fu)務(wu)(wu)效能。對(dui)于具有合法手(shou)續、完成揮(hui)發性(xing)有機物(wu)深度治(zhi)(zhi)理(li)(li)(li),實現污(wu)(wu)染(ran)物(wu)穩定(ding)達(da)標排(pai)放的(de)餐飲、洗滌、修理(li)(li)(li)等生(sheng)(sheng)活服(fu)(fu)(fu)務(wu)(wu)業,不允許采取限制(zhi)性(xing)停工停業。對(dui)不能穩定(ding)達(da)標排(pai)放或(huo)污(wu)(wu)染(ran)防(fang)治(zhi)(zhi)設(she)施不全、污(wu)(wu)染(ran)防(fang)治(zhi)(zhi)設(she)施不正常運行(xing)(xing)的(de)公共(gong)服(fu)(fu)(fu)務(wu)(wu)類企事業單位、面向大眾(zhong)提(ti)(ti)供服(fu)(fu)(fu)務(wu)(wu)的(de)商戶(hu),要加強(qiang)監督管(guan)理(li)(li)(li)和指導服(fu)(fu)(fu)務(wu)(wu),確需對(dui)相關行(xing)(xing)業進行(xing)(xing)提(ti)(ti)升(sheng)整(zheng)治(zhi)(zhi)的(de),要精準研(yan)判產(chan)(chan)污(wu)(wu)環(huan)(huan)節(jie)(jie),針對(dui)各行(xing)(xing)業產(chan)(chan)、排(pai)污(wu)(wu)節(jie)(jie)點(dian),結合各行(xing)(xing)業生(sheng)(sheng)產(chan)(chan)規律(lv)和居(ju)民(min)生(sheng)(sheng)活習慣,科學制(zhi)訂整(zheng)治(zhi)(zhi)方案并有序組(zu)織實施,整(zheng)治(zhi)(zhi)前(qian)要提(ti)(ti)前(qian)向社會發布公告。對(dui)于環(huan)(huan)境(jing)污(wu)(wu)染(ran)突出、群(qun)眾(zhong)反映強(qiang)烈(lie),嚴重影(ying)響(xiang)群(qun)眾(zhong)生(sheng)(sheng)產(chan)(chan)生(sheng)(sheng)活的(de),堅決依法予以查處(chu),責令停止排(pai)污(wu)(wu),絕不姑息(xi)遷就。

(二)嚴禁(jin)清(qing)潔取(qu)暖措(cuo)施(shi)和燃煤(mei)(mei)(mei)鍋爐淘(tao)汰(tai)“一(yi)刀(dao)(dao)切”。堅(jian)持(chi)因地制(zhi)宜(yi)(yi)(yi),多措(cuo)并舉,宜(yi)(yi)(yi)電(dian)(dian)(dian)(dian)則電(dian)(dian)(dian)(dian)、宜(yi)(yi)(yi)氣則氣、宜(yi)(yi)(yi)煤(mei)(mei)(mei)則煤(mei)(mei)(mei),加快實(shi)施(shi)冬季清(qing)潔取(qu)暖,力推(tui)(tui)電(dian)(dian)(dian)(dian)代(dai)(dai)(dai)煤(mei)(mei)(mei),穩推(tui)(tui)氣代(dai)(dai)(dai)煤(mei)(mei)(mei),積極推(tui)(tui)進(jin)風電(dian)(dian)(dian)(dian)、光伏發電(dian)(dian)(dian)(dian)、光熱能(neng)、地熱能(neng)等(deng)多種(zhong)清(qing)潔能(neng)源(yuan)(yuan)供(gong)給取(qu)暖方式,在(zai)暫不(bu)(bu)(bu)具(ju)備清(qing)潔能(neng)源(yuan)(yuan)替(ti)代(dai)(dai)(dai)的(de)山區(qu),清(qing)潔能(neng)源(yuan)(yuan)替(ti)代(dai)(dai)(dai)沒(mei)有覆蓋(gai)的(de)區(qu)域,氣源(yuan)(yuan)、電(dian)(dian)(dian)(dian)源(yuan)(yuan)沒(mei)有保障(zhang)的(de)地方,實(shi)施(shi)潔凈煤(mei)(mei)(mei)托底政策,嚴禁(jin)使用劣質散煤(mei)(mei)(mei)。對(dui)35蒸(zheng)噸/小時(shi)及(ji)以下燃煤(mei)(mei)(mei)鍋爐淘(tao)汰(tai),在(zai)氣、電(dian)(dian)(dian)(dian)源(yuan)(yuan)不(bu)(bu)(bu)能(neng)充足保障(zhang)的(de)情況下,不(bu)(bu)(bu)搞“一(yi)刀(dao)(dao)切”,積極推(tui)(tui)動(dong)各種(zhong)形式清(qing)潔替(ti)代(dai)(dai)(dai),確保群眾(zhong)溫(wen)暖過冬。要把確保群眾(zhong)取(qu)暖放在(zai)各項工(gong)作(zuo)的(de)首位,在(zai)散煤(mei)(mei)(mei)治理和清(qing)潔替(ti)代(dai)(dai)(dai)工(gong)作(zuo)中,堅(jian)持(chi)先(xian)立(li)后破(po)、不(bu)(bu)(bu)立(li)不(bu)(bu)(bu)破(po),在(zai)氣源(yuan)(yuan)、電(dian)(dian)(dian)(dian)源(yuan)(yuan)沒(mei)有充分保障(zhang)到(dao)位的(de)前提下,不(bu)(bu)(bu)得先(xian)行拆(chai)除群眾(zhong)現有取(qu)暖設(she)施(shi),在(zai)氣、電(dian)(dian)(dian)(dian)資源(yuan)(yuan)緊張時(shi),要合理調控、壓非保民(min),優先(xian)保障(zhang)群眾(zhong)溫(wen)暖過冬。

(三)嚴(yan)禁(jin)(jin)機(ji)動(dong)車(che)(che)(che)限(xian)行(xing)“一(yi)刀切”。采(cai)取機(ji)動(dong)車(che)(che)(che)限(xian)行(xing)措施(shi),應由各市(shi)(shi)人民(min)政府(含(han)定州、辛(xin)集市(shi)(shi),雄安(an)新(xin)區(qu)管(guan)委會)結合區(qu)域環境管(guan)理(li)或交通(tong)管(guan)控需求,統籌(chou)作出決定,并至(zhi)少提前(qian)1天向社會公告,除重(zhong)污染天氣(qi)紅(hong)色(se)預警期間(jian)外,原則(ze)上不(bu)得采(cai)取單(dan)雙(shuang)(shuang)號限(xian)行(xing)措施(shi);在機(ji)動(dong)車(che)(che)(che)限(xian)行(xing)期間(jian),要根據(ju)車(che)(che)(che)輛排放情況和車(che)(che)(che)型區(qu)別對(dui)待,不(bu)簡單(dan)搞(gao)單(dan)雙(shuang)(shuang)號,對(dui)軍隊、警務(wu)、消防(fang)、急救、搶險(xian)、郵政(快遞(di))、保險(xian)勘(kan)驗救援、環衛作業(ye)、市(shi)(shi)政設施(shi)維護、民(min)生保障、執法、公交、客(ke)運(yun)、出租、燃氣(qi)車(che)(che)(che)輛及新(xin)能源汽(qi)車(che)(che)(che)(純電動(dong)汽(qi)車(che)(che)(che)、插電式混合動(dong)力(li)汽(qi)車(che)(che)(che)、燃料電池(chi)汽(qi)車(che)(che)(che))不(bu)實施(shi)限(xian)行(xing)措施(shi)。對(dui)重(zhong)型柴油(you)貨車(che)(che)(che)要嚴(yan)格(ge)監管(guan),科學設計運(yun)輸線路,加(jia)密加(jia)嚴(yan)管(guan)控措施(shi),落實監測(ce)處罰機(ji)制,確保限(xian)行(xing)到位。對(dui)于使用清潔燃料減少能耗及尾氣(qi)排放、注重(zhong)運(yun)輸車(che)(che)(che)輛養(yang)護、合理(li)布局運(yun)輸線路等實施(shi)綠色(se)物流計劃(hua)的企業(ye)可視情況適當(dang)減少車(che)(che)(che)輛限(xian)行(xing)頻次,體現獎優(you)限(xian)劣,嚴(yan)禁(jin)(jin)機(ji)動(dong)車(che)(che)(che)限(xian)行(xing)“一(yi)刀切”。

(四)嚴禁對(dui)工(gong)業(ye)(ye)(ye)(ye)園(yuan)區和特色產(chan)(chan)業(ye)(ye)(ye)(ye)“一刀切(qie)”。對(dui)各(ge)級政府正式(shi)批準設(she)立的(de)(de)(de)(de)工(gong)業(ye)(ye)(ye)(ye)園(yuan)區及(ji)合法(fa)企(qi)(qi)業(ye)(ye)(ye)(ye),不(bu)得簡單(dan)要(yao)(yao)求(qiu)(qiu)停(ting)(ting)工(gong)停(ting)(ting)產(chan)(chan);對(dui)其中達不(bu)到(dao)環(huan)(huan)保要(yao)(yao)求(qiu)(qiu)的(de)(de)(de)(de)工(gong)業(ye)(ye)(ye)(ye)園(yuan)區及(ji)企(qi)(qi)業(ye)(ye)(ye)(ye),要(yao)(yao)實施(shi)“一園(yuan)一策”“一廠(chang)一策”,并(bing)根(gen)據(ju)具(ju)體環(huan)(huan)境問(wen)(wen)題(ti)采取整(zheng)改措(cuo)施(shi),不(bu)得不(bu)分青紅皂(zao)白一律采取停(ting)(ting)產(chan)(chan)整(zheng)治(zhi)(zhi)方(fang)式(shi)。對(dui)具(ju)有傳統優(you)勢,且分布(bu)相對(dui)集(ji)(ji)(ji)中的(de)(de)(de)(de)地(di)方(fang)特色產(chan)(chan)業(ye)(ye)(ye)(ye),在邊督邊改過程中要(yao)(yao)妥善處理,分類施(shi)策;對(dui)符合環(huan)(huan)境保護要(yao)(yao)求(qiu)(qiu)、穩定達標排放的(de)(de)(de)(de),不(bu)得采取集(ji)(ji)(ji)中停(ting)(ting)產(chan)(chan)整(zheng)治(zhi)(zhi)措(cuo)施(shi)。對(dui)戰略性新(xin)興(xing)產(chan)(chan)業(ye)(ye)(ye)(ye)、科技創新(xin)、電子商務、互(hu)聯(lian)網產(chan)(chan)業(ye)(ye)(ye)(ye)、文化創意設(she)計業(ye)(ye)(ye)(ye)等(deng)不(bu)能(neng)簡單(dan)要(yao)(yao)求(qiu)(qiu)停(ting)(ting)工(gong)停(ting)(ting)產(chan)(chan)。對(dui)環(huan)(huan)境污(wu)染(ran)較(jiao)重、群(qun)眾(zhong)反(fan)映(ying)突出的(de)(de)(de)(de),應(ying)當借勢借力,以督察整(zheng)改為契機,推動產(chan)(chan)業(ye)(ye)(ye)(ye)優(you)化升級,加(jia)快園(yuan)區化、集(ji)(ji)(ji)約化發展,努力提(ti)升產(chan)(chan)業(ye)(ye)(ye)(ye)水平(ping)。對(dui)群(qun)眾(zhong)舉報的(de)(de)(de)(de)具(ju)體問(wen)(wen)題(ti),要(yao)(yao)“一事一辦”,注(zhu)重舉一反(fan)三,不(bu)得簡單(dan)擴大停(ting)(ting)產(chan)(chan)整(zheng)治(zhi)(zhi)范圍。對(dui)以“園(yuan)區”名義(yi)存在的(de)(de)(de)(de)工(gong)業(ye)(ye)(ye)(ye)大院(yuan)、工(gong)業(ye)(ye)(ye)(ye)小區式(shi)“散亂污(wu)”企(qi)(qi)業(ye)(ye)(ye)(ye)集(ji)(ji)(ji)群(qun),要(yao)(yao)加(jia)強監督管理,制訂標準規范,限期停(ting)(ting)產(chan)(chan)整(zheng)治(zhi)(zhi),對(dui)嚴重污(wu)染(ran)環(huan)(huan)境的(de)(de)(de)(de)企(qi)(qi)業(ye)(ye)(ye)(ye),要(yao)(yao)堅決依法(fa)關停(ting)(ting)整(zheng)治(zhi)(zhi)到(dao)位。

(五)嚴禁(jin)環(huan)(huan)(huan)境準入“一(yi)刀(dao)切”。根據環(huan)(huan)(huan)境改善目(mu)(mu)標和主(zhu)體功能區(qu)(qu)(qu)規(gui)劃(hua)要(yao)求,以資源環(huan)(huan)(huan)境承載(zai)力(li)為(wei)判定(ding)依據,實(shi)(shi)施差別化(hua)環(huan)(huan)(huan)境準入政策,合(he)(he)理(li)優化(hua)開發布局,控制流域、區(qu)(qu)(qu)域開發強(qiang)度。在(zai)強(qiang)化(hua)空間(jian)(jian)管控的(de)同時要(yao)抓緊組織(zhi)實(shi)(shi)施區(qu)(qu)(qu)域環(huan)(huan)(huan)評(ping)(ping)(ping)、規(gui)劃(hua)環(huan)(huan)(huan)評(ping)(ping)(ping),對(dui)符(fu)合(he)(he)發展規(gui)劃(hua)和規(gui)劃(hua)環(huan)(huan)(huan)評(ping)(ping)(ping)“三線(xian)一(yi)單”要(yao)求的(de)項目(mu)(mu),簡化(hua)項目(mu)(mu)環(huan)(huan)(huan)評(ping)(ping)(ping)、排污許可(ke)等審批(pi)環(huan)(huan)(huan)節,壓縮審批(pi)時間(jian)(jian),強(qiang)化(hua)指(zhi)導服務,支持項目(mu)(mu)落地。對(dui)實(shi)(shi)施環(huan)(huan)(huan)評(ping)(ping)(ping)備案制審批(pi)改革試點(dian)區(qu)(qu)(qu)域,實(shi)(shi)施環(huan)(huan)(huan)評(ping)(ping)(ping)文件(jian)(報告表)備案管理(li),加(jia)強(qiang)事(shi)中事(shi)后管理(li)。對(dui)于不(bu)符(fu)合(he)(he)規(gui)劃(hua)、不(bu)符(fu)合(he)(he)產業政策,違反(fan)生(sheng)(sheng)態(tai)(tai)保(bao)護紅線(xian),以及在(zai)法(fa)律(lv)、法(fa)規(gui)規(gui)定(ding)禁(jin)止建(jian)設區(qu)(qu)(qu)域的(de)項目(mu)(mu),在(zai)生(sheng)(sheng)態(tai)(tai)功能區(qu)(qu)(qu)、生(sheng)(sheng)態(tai)(tai)環(huan)(huan)(huan)境敏感(gan)脆弱區(qu)(qu)(qu)域,堅(jian)持生(sheng)(sheng)態(tai)(tai)優先、嚴把審批(pi)關(guan),守(shou)住法(fa)律(lv)底(di)線(xian)、生(sheng)(sheng)態(tai)(tai)紅線(xian),堅(jian)決禁(jin)止和杜(du)絕未批(pi)先建(jian)、批(pi)建(jian)不(bu)符(fu)等違法(fa)行為(wei)。

(六)嚴(yan)(yan)禁(jin)“散(san)亂污(wu)(wu)”企(qi)(qi)業(ye)整(zheng)治(zhi)(zhi)(zhi)(zhi)“一(yi)刀切”。各地在“散(san)亂污(wu)(wu)”企(qi)(qi)業(ye)整(zheng)治(zhi)(zhi)(zhi)(zhi)工作(zuo)中(zhong),要(yao)(yao)(yao)嚴(yan)(yan)格(ge)按照(zhao)“散(san)亂污(wu)(wu)”企(qi)(qi)業(ye)界定標準,緊緊把握(wo)“污(wu)(wu)”這個核心,深(shen)入(ru)研判(pan)、科(ke)學認定“散(san)亂污(wu)(wu)”企(qi)(qi)業(ye)。對(dui)手(shou)續不全、嚴(yan)(yan)重(zhong)污(wu)(wu)染環(huan)(huan)境(jing)、不能穩定達標排放(fang)、沒有(you)治(zhi)(zhi)(zhi)(zhi)理(li)價值的企(qi)(qi)業(ye),要(yao)(yao)(yao)堅決關(guan)停(ting)取締;對(dui)有(you)整(zheng)改(gai)價值的企(qi)(qi)業(ye),要(yao)(yao)(yao)嚴(yan)(yan)格(ge)監督(du)(du)管(guan)理(li),本著(zhu)先(xian)停(ting)后治(zhi)(zhi)(zhi)(zhi)的原則,限(xian)(xian)期整(zheng)改(gai)達標,整(zheng)改(gai)驗(yan)(yan)收后方可復(fu)產(chan)。要(yao)(yao)(yao)嚴(yan)(yan)格(ge)限(xian)(xian)制“散(san)亂污(wu)(wu)”企(qi)(qi)業(ye),絕不能放(fang)松監督(du)(du)檢查,關(guan)鍵是定好標準,以(yi)嚴(yan)(yan)格(ge)整(zheng)治(zhi)(zhi)(zhi)(zhi)倒逼企(qi)(qi)業(ye)轉型(xing)升級。堅決禁(jin)止(zhi)將(jiang)不產(chan)生污(wu)(wu)染的企(qi)(qi)業(ye)列(lie)入(ru)“散(san)亂污(wu)(wu)”,堅決反對(dui)“以(yi)停(ting)代治(zhi)(zhi)(zhi)(zhi)”“以(yi)停(ting)代管(guan)”等敷(fu)衍應對(dui)做法(fa);不得對(dui)具有(you)合(he)法(fa)手(shou)續且符合(he)環(huan)(huan)境(jing)保護要(yao)(yao)(yao)求的企(qi)(qi)業(ye)采取集中(zhong)停(ting)產(chan)整(zheng)治(zhi)(zhi)(zhi)(zhi)措施(shi)(shi)。對(dui)能耗(hao)低、污(wu)(wu)染小(xiao)、科(ke)技含(han)量(liang)高(gao)、市場前(qian)景好、發展潛(qian)力大(da),但因(yin)手(shou)續不完善、規劃未落實(shi)、污(wu)(wu)染治(zhi)(zhi)(zhi)(zhi)理(li)設施(shi)(shi)不健全被列(lie)入(ru)“散(san)亂污(wu)(wu)”的企(qi)(qi)業(ye),要(yao)(yao)(yao)積(ji)極創造條件,加(jia)強規范改(gai)造、扶(fu)(fu)持(chi)(chi)提升。按照(zhao)省(sheng)委省(sheng)政府(fu)關(guan)于(yu)開展“雙(shuang)(shuang)創雙(shuang)(shuang)服”活動的實(shi)施(shi)(shi)意見和生態(tai)環(huan)(huan)境(jing)部關(guan)于(yu)深(shen)化“放(fang)管(guan)服”改(gai)革推動經(jing)濟高(gao)質量(liang)發展的有(you)關(guan)要(yao)(yao)(yao)求,對(dui)扶(fu)(fu)持(chi)(chi)提升類“散(san)亂污(wu)(wu)”企(qi)(qi)業(ye)區別對(dui)待,予以(yi)重(zhong)點幫扶(fu)(fu),開辟綠色通(tong)道,依法(fa)依規完善手(shou)續,加(jia)快推進整(zheng)合(he)搬遷、提升改(gai)造、組織(zhi)驗(yan)(yan)收,解決企(qi)(qi)業(ye)發展需要(yao)(yao)(yao)政府(fu)協調(diao)解決的問題,扶(fu)(fu)持(chi)(chi)生態(tai)友好型(xing)中(zhong)小(xiao)微企(qi)(qi)業(ye)做大(da)做強。

(七)嚴(yan)(yan)禁建筑施(shi)(shi)(shi)(shi)工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)程(cheng)停(ting)(ting)工(gong)(gong)(gong)(gong)“一刀切”。對(dui)(dui)于依(yi)法(fa)依(yi)規取(qu)(qu)(qu)得(de)施(shi)(shi)(shi)(shi)工(gong)(gong)(gong)(gong)許(xu)可(ke)的(de)(de)(de)(de)各(ge)類建筑工(gong)(gong)(gong)(gong)程(cheng)項目(mu)(mu)(含取(qu)(qu)(qu)得(de)施(shi)(shi)(shi)(shi)工(gong)(gong)(gong)(gong)許(xu)可(ke)的(de)(de)(de)(de)重(zhong)(zhong)大(da)(da)基(ji)礎設施(shi)(shi)(shi)(shi)項目(mu)(mu)),在確(que)保(bao)(bao)(bao)污染(ran)防(fang)治設施(shi)(shi)(shi)(shi)與(yu)揚塵管控措(cuo)施(shi)(shi)(shi)(shi)到(dao)位(wei)(wei)的(de)(de)(de)(de)情況下(xia)(xia),秋冬季可(ke)以正(zheng)常(chang)施(shi)(shi)(shi)(shi)工(gong)(gong)(gong)(gong)。重(zhong)(zhong)污染(ran)天氣應(ying)(ying)急響應(ying)(ying)期(qi)間,在嚴(yan)(yan)格落實(shi)“六個百(bai)(bai)分(fen)之百(bai)(bai)”和“兩個全(quan)覆蓋”要(yao)求(qiu)(qiu)的(de)(de)(de)(de)情況下(xia)(xia),優先保(bao)(bao)(bao)障國家和省(sheng)重(zhong)(zhong)點項目(mu)(mu)、扶貧易地搬遷項目(mu)(mu)和當地政(zheng)府確(que)定(ding)的(de)(de)(de)(de)民(min)生(sheng)工(gong)(gong)(gong)(gong)程(cheng)正(zheng)常(chang)施(shi)(shi)(shi)(shi)工(gong)(gong)(gong)(gong);市(shi)(shi)、縣(xian)重(zhong)(zhong)點項目(mu)(mu)由市(shi)(shi)、縣(xian)人民(min)政(zheng)府根據(ju)本區域環(huan)(huan)境(jing)(jing)管理需(xu)求(qiu)(qiu)和重(zhong)(zhong)污染(ran)天氣應(ying)(ying)急預案要(yao)求(qiu)(qiu),制定(ding)具體管控措(cuo)施(shi)(shi)(shi)(shi),實(shi)現清(qing)單化管理;其他(ta)工(gong)(gong)(gong)(gong)程(cheng)項目(mu)(mu)除土石(shi)方(含破拆、改(gai)造)工(gong)(gong)(gong)(gong)程(cheng)停(ting)(ting)工(gong)(gong)(gong)(gong)外,室內(nei)地面鋪裝、內(nei)外墻(qiang)體及內(nei)部(bu)裝修等(deng)工(gong)(gong)(gong)(gong)序,在嚴(yan)(yan)格落實(shi)環(huan)(huan)境(jing)(jing)保(bao)(bao)(bao)護措(cuo)施(shi)(shi)(shi)(shi)的(de)(de)(de)(de)前(qian)提下(xia)(xia),可(ke)不采取(qu)(qu)(qu)停(ting)(ting)工(gong)(gong)(gong)(gong)措(cuo)施(shi)(shi)(shi)(shi);為重(zhong)(zhong)點項目(mu)(mu)配(pei)套的(de)(de)(de)(de)砂(sha)石(shi)料場(chang)、商品砼企(qi)業(ye),在嚴(yan)(yan)格落實(shi)環(huan)(huan)保(bao)(bao)(bao)措(cuo)施(shi)(shi)(shi)(shi)要(yao)求(qiu)(qiu)、環(huan)(huan)保(bao)(bao)(bao)設施(shi)(shi)(shi)(shi)健全(quan)并(bing)穩(wen)定(ding)運行(xing)(xing)(xing),確(que)保(bao)(bao)(bao)污染(ran)物穩(wen)定(ding)達(da)(da)標排放(fang)的(de)(de)(de)(de)情況下(xia)(xia),可(ke)采取(qu)(qu)(qu)輪換(huan)生(sheng)產等(deng)減排措(cuo)施(shi)(shi)(shi)(shi),確(que)保(bao)(bao)(bao)國、省(sheng)重(zhong)(zhong)點項目(mu)(mu)建設需(xu)要(yao)。其中,污染(ran)防(fang)治設施(shi)(shi)(shi)(shi)不全(quan)或不穩(wen)定(ding)運行(xing)(xing)(xing),沒(mei)有達(da)(da)到(dao)環(huan)(huan)境(jing)(jing)保(bao)(bao)(bao)護要(yao)求(qiu)(qiu)的(de)(de)(de)(de),要(yao)立即停(ting)(ting)止(zhi)排污,限期(qi)整改(gai)到(dao)位(wei)(wei);對(dui)(dui)出現環(huan)(huan)境(jing)(jing)違(wei)法(fa)行(xing)(xing)(xing)為的(de)(de)(de)(de),堅決依(yi)法(fa)處(chu)罰到(dao)位(wei)(wei)。對(dui)(dui)不能按期(qi)完成整改(gai)的(de)(de)(de)(de)企(qi)業(ye)或項目(mu)(mu),對(dui)(dui)存(cun)在環(huan)(huan)境(jing)(jing)違(wei)法(fa)行(xing)(xing)(xing)為、嚴(yan)(yan)重(zhong)(zhong)污染(ran)環(huan)(huan)境(jing)(jing)的(de)(de)(de)(de)企(qi)業(ye)或項目(mu)(mu),要(yao)依(yi)法(fa)依(yi)規處(chu)罰,各(ge)級住建、環(huan)(huan)保(bao)(bao)(bao)等(deng)部(bu)門要(yao)加大(da)(da)執法(fa)檢查(cha)力度,堅決責令停(ting)(ting)止(zhi)施(shi)(shi)(shi)(shi)工(gong)(gong)(gong)(gong)。

(八)嚴禁(jin)錯峰生(sheng)(sheng)產(chan)(chan)(chan)(chan)(chan)“一刀切”。各地要加強調查研(yan)究,對每一個涉(she)污(wu)企(qi)業(ye)分(fen)析評估(gu),依據環境管理(li)(li)目標(biao)需求,根據排(pai)放(fang)量(liang)及排(pai)放(fang)強度分(fen)級(ji)分(fen)類(lei)管控,建立(li)秋冬季錯峰生(sheng)(sheng)產(chan)(chan)(chan)(chan)(chan)企(qi)業(ye)清(qing)單(落實(shi)到工序(xu)、設(she)備),制(zhi)定錯峰生(sheng)(sheng)產(chan)(chan)(chan)(chan)(chan)方(fang)案,面向(xiang)社會公示,接受群(qun)眾監督。對鋼鐵、焦化(hua)(hua)(hua)(hua)、鑄造(zao)、建材、碳素、化(hua)(hua)(hua)(hua)學原料(liao)藥(yao)(農藥(yao))、有(you)色、化(hua)(hua)(hua)(hua)工制(zhi)造(zao)等(deng)高污(wu)染排(pai)放(fang)行業(ye),符(fu)合(he)現行產(chan)(chan)(chan)(chan)(chan)業(ye)政策,污(wu)染物(wu)能(neng)夠實(shi)現穩定達標(biao)排(pai)放(fang)且(qie)依法(fa)獲得排(pai)污(wu)許可(ke)證的,要按(an)照排(pai)放(fang)績效評價,秋冬季采(cai)取(qu)差異(yi)化(hua)(hua)(hua)(hua)錯峰生(sheng)(sheng)產(chan)(chan)(chan)(chan)(chan)。鼓勵重點行業(ye)企(qi)業(ye)進行產(chan)(chan)(chan)(chan)(chan)業(ye)升級(ji)、技術升級(ji)、管理(li)(li)升級(ji),打造(zao)生(sheng)(sheng)態(tai)環境保護“領跑(pao)者”企(qi)業(ye)。對實(shi)現超低排(pai)放(fang)、工藝技術先進、產(chan)(chan)(chan)(chan)(chan)品優質高端的“領跑(pao)者”企(qi)業(ye),不(bu)列入(ru)錯峰生(sheng)(sheng)產(chan)(chan)(chan)(chan)(chan)名單;對其他不(bu)涉(she)及煙粉塵、二氧化(hua)(hua)(hua)(hua)硫(liu)、氮氧化(hua)(hua)(hua)(hua)物(wu)、一氧化(hua)(hua)(hua)(hua)碳等(deng)污(wu)染物(wu)和VOCs排(pai)放(fang)的企(qi)業(ye)(或工序(xu)、生(sheng)(sheng)產(chan)(chan)(chan)(chan)(chan)線(xian)),不(bu)列入(ru)錯峰生(sheng)(sheng)產(chan)(chan)(chan)(chan)(chan)名單,嚴禁(jin)“一刀切”式停(ting)限產(chan)(chan)(chan)(chan)(chan)。對無證排(pai)污(wu)、偷排(pai)偷放(fang)、超標(biao)排(pai)放(fang)的企(qi)業(ye),堅決(jue)依法(fa)查處,嚴懲重罰,第一時(shi)間停(ting)止排(pai)污(wu),第一時(shi)間停(ting)產(chan)(chan)(chan)(chan)(chan)整(zheng)治,對于拒不(bu)整(zheng)改的,采(cai)取(qu)按(an)日(ri)計罰、查封扣押、行政拘留、移(yi)交司法(fa)機關等(deng)強制(zhi)措施。

    (九)嚴(yan)(yan)禁(jin)重污(wu)染(ran)天(tian)(tian)氣(qi)應急(ji)(ji)響(xiang)(xiang)應“一刀切”。各地要科學(xue)研判,提(ti)前(qian)預(yu)(yu)警,逐個(ge)企(qi)業(ye)制定重污(wu)染(ran)天(tian)(tian)氣(qi)應急(ji)(ji)預(yu)(yu)案,細化到(dao)生(sheng)產線(xian)、工序和(he)(he)(he)設(she)備,并(bing)在企(qi)業(ye)明顯位置公示,接受社會(hui)監督。要嚴(yan)(yan)格按照重污(wu)染(ran)天(tian)(tian)氣(qi)預(yu)(yu)警級別啟動重污(wu)染(ran)天(tian)(tian)氣(qi)響(xiang)(xiang)應措(cuo)(cuo)施(shi)(shi)(除(chu)國(guo)家(jia)要求和(he)(he)(he)重大活(huo)動保障(zhang)任務需(xu)要外),提(ti)前(qian)1 - 2天(tian)(tian)發(fa)布預(yu)(yu)警信息,給足(zu)企(qi)業(ye)應急(ji)(ji)響(xiang)(xiang)應準備時(shi)間,嚴(yan)(yan)禁(jin)擅自(zi)提(ti)高(gao)預(yu)(yu)警級別,擴大預(yu)(yu)警范(fan)圍(wei)。重污(wu)染(ran)天(tian)(tian)氣(qi)期間,對能夠穩定達到(dao)國(guo)家(jia)或省規定的(de)超低排(pai)放限值的(de)工序和(he)(he)(he)設(she)備,達到(dao)“綠色(se)”建(jian)材行業(ye)大氣(qi)污(wu)染(ran)物排(pai)放標準目標的(de)企(qi)業(ye),按照“多排(pai)多限、少排(pai)少限、不(bu)排(pai)不(bu)限”的(de)原則,采(cai)取適度應急(ji)(ji)減排(pai)措(cuo)(cuo)施(shi)(shi),嚴(yan)(yan)禁(jin)“一刀切”。

(十)嚴禁(jin)督(du)(du)察(cha)執(zhi)(zhi)法(fa)(fa)(fa)檢(jian)查“一(yi)(yi)刀切”。專(zhuan)項(xiang)督(du)(du)察(cha)和強(qiang)化督(du)(du)查是打贏(ying)藍天保衛(wei)戰的(de)既(ji)定部署(shu)和保障(zhang)(zhang)措施,執(zhi)(zhi)法(fa)(fa)(fa)檢(jian)查是加強(qiang)環(huan)(huan)境監管和打擊(ji)環(huan)(huan)境違法(fa)(fa)(fa)行為的(de)必(bi)然要(yao)求,要(yao)堅定不(bu)(bu)移、真督(du)(du)實查、不(bu)(bu)循私情(qing)、鐵腕執(zhi)(zhi)法(fa)(fa)(fa),但(dan)決(jue)不(bu)(bu)允許(xu)借(jie)中央、省級(ji)環(huan)(huan)保督(du)(du)察(cha)、專(zhuan)項(xiang)督(du)(du)察(cha)、執(zhi)(zhi)法(fa)(fa)(fa)檢(jian)查等(deng)名義采取(qu)一(yi)(yi)律(lv)停(ting)(ting)工停(ting)(ting)業(ye)停(ting)(ting)產的(de)敷衍整(zheng)(zheng)(zheng)改(gai)、機械整(zheng)(zheng)(zheng)改(gai)、表面(mian)整(zheng)(zheng)(zheng)改(gai)做法(fa)(fa)(fa),以免(mian)影響(xiang)企業(ye)正常(chang)(chang)生(sheng)(sheng)產和群(qun)眾正常(chang)(chang)生(sheng)(sheng)活。要(yao)聚焦交(jiao)辦(ban)問(wen)題深入抓好整(zheng)(zheng)(zheng)改(gai),舉(ju)一(yi)(yi)反三全面(mian)排查整(zheng)(zheng)(zheng)治(zhi),嚴禁(jin)對(dui)督(du)(du)查交(jiao)辦(ban)的(de)問(wen)題,不(bu)(bu)調查、不(bu)(bu)研(yan)究(jiu)、不(bu)(bu)治(zhi)理,而(er)采取(qu)“一(yi)(yi)停(ting)(ting)了之”“以停(ting)(ting)代治(zhi)”“不(bu)(bu)聞不(bu)(bu)問(wen)”的(de)“障(zhang)(zhang)眼法(fa)(fa)(fa)”或“常(chang)(chang)停(ting)(ting)久治(zhi)”“久治(zhi)不(bu)(bu)驗”等(deng)“拖延術”,嚴禁(jin)應(ying)付督(du)(du)察(cha)檢(jian)查搞“一(yi)(yi)刀切”,堅決(jue)避免(mian)集中停(ting)(ting)工停(ting)(ting)業(ye)停(ting)(ting)產等(deng)簡單(dan)粗暴行為。


四、保障措施

(一)突(tu)出黨(dang)委(wei)、政(zheng)(zheng)(zheng)府主體責任。各級黨(dang)委(wei)、政(zheng)(zheng)(zheng)府要(yao)(yao)全面(mian)落(luo)實(shi)生(sheng)態環(huan)境(jing)保(bao)護“黨(dang)政(zheng)(zheng)(zheng)同責”“一崗雙責”主體責任,按(an)照“屬地管理”和(he)“管發展(zhan)(zhan)的(de)管環(huan)保(bao)、管生(sheng)產的(de)管環(huan)保(bao)、管行(xing)(xing)業(ye)(ye)的(de)管環(huan)保(bao)”要(yao)(yao)求,加(jia)強對本(ben)行(xing)(xing)政(zheng)(zheng)(zheng)區(qu)域(yu)或(huo)分管行(xing)(xing)業(ye)(ye)領(ling)域(yu)內(nei)(nei)污染治理工作的(de)組織領(ling)導和(he)科(ke)學統籌(chou),要(yao)(yao)深(shen)(shen)入基層、深(shen)(shen)入實(shi)際調查研(yan)究,精細制定差異化管控措施(shi),分類施(shi)策、精準(zhun)治理,實(shi)行(xing)(xing)清單式(shi)管理并向社會公開。要(yao)(yao)對轄區(qu)內(nei)(nei)或(huo)分管行(xing)(xing)業(ye)(ye)領(ling)域(yu)內(nei)(nei)存(cun)在的(de)“一刀切”問題進(jin)行(xing)(xing)全面(mian)排查,及時(shi)發現(xian)和(he)糾正存(cun)在的(de)問題。要(yao)(yao)強化環(huan)保(bao)、質量、技術(shu)、能耗、安(an)全等(deng)標(biao)準(zhun)倒逼,加(jia)大(da)財稅和(he)金(jin)融政(zheng)(zheng)(zheng)策扶持(chi)力度,突(tu)出環(huan)保(bao)引領(ling),實(shi)現(xian)轉型提(ti)升,推動綠色發展(zhan)(zhan)。

(二)強(qiang)化部(bu)(bu)門監管責(ze)任。有(you)關職能部(bu)(bu)門要加強(qiang)對(dui)分管領(ling)域工(gong)作的(de)調查(cha)(cha)研究和(he)監督(du)管理,堅(jian)(jian)決杜絕通(tong)過“發通(tong)知、打(da)招呼”等臨時(shi)性“一刀(dao)切(qie)”關停(ting)方(fang)式(shi),堅(jian)(jian)決反(fan)對(dui)生態環境(jing)(jing)保(bao)(bao)護(hu)領(ling)域的(de)“一刀(dao)切(qie)”等形(xing)式(shi)主(zhu)義(yi)、官僚主(zhu)義(yi)問題,堅(jian)(jian)決反(fan)對(dui)生態環境(jing)(jing)問題的(de)虛假(jia)整(zheng)(zheng)改、敷衍(yan)整(zheng)(zheng)改、表面(mian)整(zheng)(zheng)改,堅(jian)(jian)決反(fan)對(dui)“一刀(dao)切(qie)”粗暴的(de)管控(kong)措施,應付環保(bao)(bao)督(du)察(cha)檢查(cha)(cha)。對(dui)有(you)關職能部(bu)(bu)門在貫徹落實(shi)防止“一刀(dao)切(qie)”方(fang)面(mian)工(gong)作部(bu)(bu)署不(bu)力、失職瀆職,造成不(bu)良影(ying)響和(he)后果的(de),依法依規(gui)予以追(zhui)責(ze)問責(ze)。

(三)嚴(yan)格落實企(qi)業治(zhi)污(wu)主體責任。要(yao)進一(yi)步(bu)提升企(qi)業環境守法(fa)意識,督促加強環保設施建設和(he)運行管理,引(yin)導企(qi)業開展深度治(zhi)理和(he)提標改造,切實減少污(wu)染排放。對弄虛作假、違(wei)(wei)法(fa)生產(chan)、偷(tou)排偷(tou)放、超(chao)標排放、無證排污(wu)等違(wei)(wei)法(fa)違(wei)(wei)規(gui)行為,要(yao)一(yi)以貫之地保持嚴(yan)查(cha)重(zhong)處(chu)的高壓態勢,一(yi)經發(fa)現,一(yi)律依(yi)法(fa)依(yi)規(gui)嚴(yan)肅查(cha)處(chu)。
